How to refuse an offer of contract from a corporation

When you get a letter in a windowed envelope with a "notice" asking you to pay for something you have to realise that a notice is not a bill, it's an offer of contract and the act of opening the letter is in effect your acceptance of the offer of contract. If you don't open the letter and send it back there is no contract and there is no obligation to pay until a contract has been established. If the letter has a return address that you can't identify (such as a PO box) then you can also legally send it back as the sender hasn't identified themselves properly.

If a third party such as solicitor or a debt collection agency sends any letter demanding you pay the "bill" "account" or any other fictitious legal term they try to convey then you have to realise that you have never signed a contract (mutual agreement) with them so they don't have a legal leg to stand on, just send their offer of contract back to them.

Many of the conveyances that come through our letter boxes are simple offers of contract and the act of opening letter is accepting the offer contract. Just don't open it, send it back back and mark the front of the envelope.

I really don't want anyone to get into trouble over this, so put the money aside for just one "notice" or offer of contract that comes in the form of a letter with no identifiable sender ie with a PO box as a return address and see what comes of it. I've only tried it once with a council fine when my dog was impounded and so far (8weeks) there's been no response. So I don't know if it worked or if they just don't know what to do next.

This is all starting to look like any other commercial agreement where mutual acceptance of terms is required for the terms of the contract to be initiated. So I don't see this as any breach of the law but more of a choice not to accept an offer of contract and I intend to play it out as far it can go, it's not a criminal matter so I'll play their civil game by their own civil laws and they can be civil too or I'll see them in court. Then we can discuss jurisdiction & liability ;)

Yes I might try this to let us know how it goes for you. Maybe I should try it with my council rates that I will get in the next couple of months🤣

I don't know if I'd try it with council rates, if they don't get their extortion/rates they're likely to come after the house. Maybe as a delaying tactic it could buy some time and put them on hold for a while though.

We've had 2 referendums where the Australian public were asked if we should have local government and both times the Australian people have said no, so council is really an illegitimate form of government that shouldn't exist. If an entire district or even just a large percentage of the district banded together and started sending their "notices" back it could get really interesting. The burden of the legal bills the council racked up chasing all that bad debt could bury it.

Yes very true and I know people were I live don't beat to pay there water bills so I will keep pushing for some community revolt against paying them haha see what happens. I can't stand the local council they have turn so money hungry in the last couple of years.

EXACTLY when you upvoted my recycling post tonight, to the precise minute as evidenced by my iphone picture, I found another keyboard outside on the curbs. Worth about $75, but a nice compact one with some wheels on it. I'm not sure how you continue to generate keyboards for me. That's crazy talk.

I found and polished these Sterling Silver earrings I sold to Japan for $200.

I also found this Sterling Silver bracelet/charms with one 14K gold charm on it recently.

Jewelry isn't too common since most people wouldn't toss it, but it's also usually small and hard to find when walking on the curbs.

I did find a bracelet at SF3 that seems to have lots of little diamonds on it. I think it was gold too, but haven't looked at it in a while. I also found one gold earring.

I was living in a van before i left Uk and went travelling in it. I had already learnt about common law and the meanings of the words such as Parking Notice, and delved deep into lawful and legal (2 different things being smudged as 1) and I had around 12 parking tickets that i returned whilst signed as NO CONTRACT.
I even had stamps already stuck on envelopes in the side door and would hear the windscreen wiper getting slammed onto the windscreen as they put the ticket there. I had the time to go out, take the ticket, sign it and put it in the envelope and even would then ask the ticket bully if he or she would be so kind to put it in the next post box they past on the way 😂

My legal personility of which is totally fictional and I am not connected with, owes around 7000squids and there was bailiffs at my parents house a few times,and many red letters, but then since a while theres been nothing.
Oh and train ticket charges from across europe, which even the train conductor knows it wont ever get paid 😂

That's awesome when people throw a spanner in the works & don't play their game the way they expect it to be played. I can imagine the meeting in the office when they tried work out how to deal with the returned letters, the legal consult would probably cost more than the bogus parking fine would have raised if you did pay it.
